Part A. Website terms of use

1. Information on this website

This website is published by Al Hikma Groups ("we", "us") for business buyers. Product descriptions, specifications, packaging options and availability are provided for general information. They do not constitute an offer capable of acceptance. Availability of agricultural products varies with season, weather and supply, and details are confirmed only in a written quotation.

2. Quotations

Commercial terms are provided in a written quotation after we review the buyer's requirements, product availability and shipment details. A quotation is subject to the validity period and conditions stated in it.

3. Quotation requests

Submitting a quotation request does not create an order or any obligation on either party. You confirm that the information you provide is accurate and that you are authorised to make the enquiry on behalf of your company. We may decline to quote at our discretion.

4. Acceptable use

You agree not to submit false, misleading or automated enquiries, attempt to disrupt the website, or copy its content for commercial purposes without permission.

5. Intellectual property

The text, design and logo on this website belong to us or are used under licence. Photography credits are listed in the site's image provenance file where third-party images are used.

6. Liability

We take care to keep this website accurate but do not guarantee that it is free of errors or always available. To the extent permitted by law we are not liable for loss arising from reliance on website content. Nothing here limits liability that cannot be limited by law.

Part B. General export terms

The following general terms apply to quotations we issue and orders we accept unless a signed contract or the written quotation states otherwise. Where they conflict, the written quotation or contract prevails.

7. Quotations and orders

• Quotations are valid for the period stated in the quotation. If no period is stated, they are valid for 7 days.
• An order is accepted only when we confirm it in writing (proforma invoice or order confirmation).
• Quantities for fresh produce are agreed per shipment and may be subject to a tolerance stated in the quotation.

8. Specification and quality

• Goods are supplied to the grade, size, variety and packaging specification agreed in writing.
• Fresh produce is a natural product. Reasonable variation in size, colour and appearance within the agreed grade does not constitute a defect.
• Pre-shipment inspection by an independent agency can be arranged at the buyer's request and cost unless agreed otherwise.

9. Packaging and labelling

Standard export packaging is described in the quotation. Buyer-specific cartons, net weights, labels or private-label requirements must be confirmed in writing before the order is accepted and may affect the quoted commercial terms and lead time.

10. Delivery and Incoterms

• Delivery terms follow Incoterms 2020 (for example EXW, FOB or CIF) as stated in the quotation.
• Shipment dates are estimates given in good faith. Perishable produce is dispatched to match carrier schedules, and delays caused by carriers, weather, customs or events outside our control do not entitle the buyer to cancel or claim damages.
• Risk passes to the buyer in accordance with the agreed Incoterm.

11. Payment

• Payment terms are agreed for each order and stated in the quotation or proforma invoice. Typical arrangements are advance payment or an irrevocable letter of credit from an acceptable bank.
• Credit terms are not offered automatically and are never implied by any content on this website.
• Bank charges outside India are for the buyer's account unless agreed otherwise.

12. Import requirements

The buyer is responsible for confirming that the goods may be imported into the destination country and for obtaining any import permits or registrations required. We provide the export documentation agreed in the quotation, including phytosanitary certification where applicable.

13. Claims

• Shortages or visible damage must be noted on the carrier's delivery document and reported to us in writing within 24 hours of arrival for fresh produce and within 7 days for other goods, with photographs and inspection evidence.
• Claims are assessed on the evidence and settled by replacement, credit or refund as agreed. Our liability is limited to the invoice value of the affected goods.

14. Force majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control, including crop failure, extreme weather, transport disruption, government action or export restrictions.

15. Governing law

Unless agreed otherwise in writing, these terms and any order are governed by the laws of India. The parties will attempt to resolve disputes amicably before pursuing other remedies.
